At Re:Yes Law PLLC, we fundamentally believe that an individual’s civil liberties and freedoms are too precious to extinguish (unless there is clear and convincing evidence requiring action to protect that person’s own safety).

An Adult Guardianship can arise in multiple ways, see for example Netflix’s Dirty Money: Guardian Inc., which shows a couple examples of adult individuals who are considered wards of the state. Their rights have been terminated after the court determined that they were incapacitated. They lose the right to manage their money, such as one individual who is given a controlled monthly allowance. They can be forced to leave their homes and enter nursing homes against their wishes. Their property is sold, whether they want to or not.

Frequently asked questions

What are the types of guardianships?

The court may appoint a guardian of the person and/or a guardian of the finances. As it sounds, the former involves a guardian who makes all significant decisions regarding the care of the ward’s body, such as medical care. So, the guardian chooses what medicine the ward takes and whether it is better for that person to be in his home or elsewhere. As it sounds also, the latter involves a guardian who makes all significant decision regarding the money/assets that the ward possesses. Technically, the ward does not really possess the property anymore since he cannot access or control it. 

While the adult guardianship laws have a similar structure of child guardianship, that is, that the guardian is under instruction to work for the best interest of the ward, the guardian is paid for providing those services–which may lead to its own problems.
